This document constitutes a legally binding agreement between You and WLLNSS sp. z o.o. It serves simultaneously as the Terms & Conditions and the End User Licence Agreement (EULA) required under Apple App Store Review Guidelines §3.1.1.
By downloading, installing or using the WLLNSS application You confirm that:
If you do not agree to these Terms, you must stop using the Service and uninstall the Application.
Words with initial capital letters have the meanings defined below. Definitions apply equally in singular and plural.
Application — the WLLNSS mobile and web software platform, including all updates and related features.
Application Store — the Apple App Store (Apple Inc.) or Google Play Store (Google Inc.) through which the Application may be downloaded.
Affiliate — any entity that controls, is controlled by, or is under common control with a party, where 'control' means ownership of 50% or more of voting securities.
Company / WLLNSS / We / Us / Our — WLLNSS sp. z o.o., a company incorporated in Poland, with registered address at Aleja Solidarności 117/615, 00-140 Warsaw.
Country — Republic of Poland.
Device — any electronic device capable of accessing the Service, including a smartphone, tablet or computer.
Healthcare Professional — an independent, licensed medical doctor, therapist, psychologist or other healthcare provider offering consultations through the Platform.
Service / Platform — the Application and all associated features, content and tools provided by WLLNSS.
Terms / EULA — this document, as updated from time to time.
You / User — the individual accessing or using the Service.
These Terms govern Your access to and use of the Service and constitute the entire agreement between You and WLLNSS regarding the Service. By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part, You must not access the Service.
This document constitutes the End User Licence Agreement required pursuant to Apple App Store Review Guidelines (Section 3.1.1). The Apple standard EULA is expressly NOT adopted; this document governs instead.
Apple Inc. is not a party to this EULA, has no obligation or liability whatsoever to You under this EULA, and is not responsible for the Application or its content. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and, upon Your acceptance, will have the right (and will be deemed to have accepted the right) to enforce this EULA against You as a third-party beneficiary.
The Service is available exclusively to persons aged 18 or older. By using the Service You confirm that You are at least 18 years of age. WLLNSS implements age-verification controls at the point of registration, which may include requiring users to confirm their date of birth and, where required by law or platform guidelines, additional verification steps. We reserve the right to implement enhanced age-verification measures at any time. Where WLLNSS has reasonable grounds to believe that a user is under the age of 18, access to the Service will be suspended immediately and associated personal data deleted without undue delay, except where retention is required by applicable law. If You are under 18 years of age, You must not use the Service.
Subject to Your compliance with these Terms, WLLNSS grants You a limited, personal, non-exclusive, non-transferable, revocable licence to:

WLLNSS is a technology and wellbeing platform. The Service may include: wellbeing and lifestyle programmes; AI-based wellbeing features; educational content; access to independent Healthcare Professionals; and optional paid services or subscriptions.
WLLNSS does NOT provide medical services.
WLLNSS does NOT diagnose, treat, cure or prevent any medical condition.
WLLNSS does NOT provide emergency care or crisis intervention.
WLLNSS does NOT replace the professional judgement of a licensed healthcare provider.
IN A MEDICAL EMERGENCY, CALL YOUR LOCAL EMERGENCY SERVICES IMMEDIATELY (e.g. 112 in the EU, 999 in the UK, 911 in the US).
Medical and therapeutic consultations available through the Platform are provided exclusively by independent, licensed Healthcare Professionals and not by WLLNSS.
Availability of specific features may vary by region. WLLNSS reserves the right to modify, suspend or discontinue any feature at any time with reasonable prior notice to affected Users.
The Application includes artificial intelligence features designed for general wellbeing and informational purposes only. These features are not a substitute for professional medical advice, diagnosis or treatment. Certain AI functionalities may be provided in cooperation with third-party technology providers. Further details regarding such providers and data processing are available in the Privacy Policy.
AI features are NOT medical advice and are NOT reviewed by Healthcare Professionals.
AI features must NOT be relied upon for any medical decision.
AI features do NOT address: emergencies, oncology, pregnancy, psychiatric conditions, pediatrics, medication dosage or prescriptions.
AI-generated outputs may be inaccurate, incomplete, outdated or unsuitable for your circumstances. You should use independent judgment and seek qualified professional advice where appropriate.
Always seek the advice of a qualified healthcare provider for any medical concerns.
The AI features provided within the Service are not classified as high-risk AI systems under Regulation (EU) 2024/1689 (EU Artificial Intelligence Act), as they do not autonomously make decisions with significant legal or equivalent effects on individuals. All AI outputs are labelled as informational content within the Application.
Certain optional services or paid features within the Service (including, where available, consultations or other premium offerings) may be offered for separate payment. All applicable prices, fees and purchase terms will be clearly presented to You before You confirm any purchase.
Unless expressly stated otherwise at the point of purchase, paid features are one-time purchases and do not automatically renew.
Where a purchase is made through the Apple App Store on an iOS device, the transaction is processed by Apple Inc. in accordance with Apple’s applicable payment terms and policies. WLLNSS does not receive or store Your full payment card details for such transactions. Payments for consultations with independent healthcare professionals may be processed through Stripe or another authorized payment provider. Such consultations constitute professional services provided by independent practitioners and not digital content sold by WLLNSS.
For billing issues, payment disputes or refund requests relating to Apple App Store purchases, please contact Apple Support: https://support.apple.com.
Where permitted by applicable platform rules and where made available by WLLNSS, certain optional services may also be purchased directly through the WLLNSS website or web platform. Such transactions are processed via Stripe or another designated payment provider, and WLLNSS sp. z o.o. is the merchant of record for those purchases. WLLNSS does not collect, store or process Your full payment card details. All payment card data is processed exclusively by the designated payment provider in accordance with applicable Payment Card Industry Data Security Standards (PCI DSS). By making a direct purchase, You agree to the applicable terms and privacy policy of the relevant payment provider. Refunds for direct purchases are governed by applicable law and any specific service terms presented at the time of purchase.
Users may access certain features through a corporate agreement between their employer and WLLNSS. Employer-sponsored access:
Your employer is not responsible for purchases made independently by You.
If You are an EU/EEA consumer purchasing digital services directly from WLLNSS through the website or web platform, You may have a statutory right to withdraw from the contract within 14 days, subject to applicable consumer laws.
Where digital content or digital services begin immediately at Your request, You may be asked to provide prior express consent acknowledging that You may lose the right of withdrawal once performance has started, to the extent permitted by law.

In accordance with Directive 2011/83/EU (Consumer Rights Directive) and the Polish Consumer Rights Act (Ustawa z dnia 30 maja 2014 r. o prawach konsumenta), if You are a consumer resident in the EU/EEA, You have the right to withdraw from a distance contract within 14 calendar days from the date of conclusion of the contract, without giving any reason.
EXCEPTION: You lose the right of withdrawal in respect of digital content where performance has commenced with Your express prior consent and acknowledgement that You thereby forfeit the right of withdrawal.
To exercise this right, contact: s.atanasov@wllnss.health with subject line 'Withdrawal from Contract', stating Your name, order details and the date of purchase. We will process Your request without undue delay.
Where You access the Service through Your employer:
The legal bases for processing Your personal data in the context of employer-sponsored access are set out in detail in Our Privacy Policy. Such processing may be conducted on the basis of Article 6(1)(b), 6(1)(f), and, where applicable, Article 9(2)(a) of the GDPR. Your individual health data remain subject to the same protections as described in Part J of these Terms, regardless of the basis on which You access the Service.
Healthcare consultations available through the Platform are delivered by independent, licensed Healthcare Professionals or licensed clinics. WLLNSS:
Consultation formats may include text chat, audio call, video call or asynchronous messaging. Each Healthcare Professional is individually responsible for their practice under their professional regulatory obligations. Your relationship with a Healthcare Professional is solely between You and that professional.
By using the Service You agree to:

Personal data and health data are processed in accordance with: Regulation (EU) 2016/679 (GDPR); Directive 2002/58/EC (ePrivacy Directive); and applicable Polish data protection legislation (Ustawa z dnia 10 maja 2018 r. o ochronie danych osobowych).

Health data constitute a special category of personal data under GDPR Article 9. WLLNSS processes Your health data solely on the basis of Your explicit, freely given, specific and informed consent. You may withdraw Your consent at any time through the in-app Privacy Settings or by contacting i.kuzmitski@wllnss.health. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.
WLLNSS acts as a data controller in respect of Your personal data. Where WLLNSS processes data on behalf of Your employer, it acts as a data processor pursuant to a separate Data Processing Agreement.
Personal data are retained for as long as necessary for the purposes for which they were collected, or as required by applicable law. Health data are deleted upon account closure or withdrawal of consent, unless their retention is required by applicable law. In particular, where WLLNSS creates or stores medical documentation in connection with healthcare services provided through the Platform, such documentation is subject to mandatory statutory retention periods under Polish law — including the Act of 6 November 2008 on Patient Rights and the Patient Rights Ombudsman — which may require retention for up to 20 years (or longer in specific circumstances, such as 30 years in cases of patient death caused by bodily injury or poisoning, or 22 years for documentation relating to children under the age of 2). Withdrawal of consent or account closure does not override these statutory obligations. Full details of applicable retention periods are set out in the Privacy Policy.
Under the GDPR You have the right to: access Your personal data; rectification; erasure ('right to be forgotten'); restriction of processing; data portability; and to object to processing. To exercise any of these rights, contact: i.kuzmitski@wllnss.health.
You also have the right to lodge a complaint with the Polish supervisory authority: Urząd Ochrony Danych Osobowych (UODO), ul. Stawki 2, 00-193 Warsaw — www.uodo.gov.pl.
Full details of Our data practices, including third-party data sharing, international transfers and cookie use, are set out in Our Privacy Policy, which forms an integral part of these Terms. Where the Service includes advertising displayed on Our website, such processing is conducted in accordance with the Privacy Policy, which specifies the applicable legal basis and user choices. We do not share Your personal data with third-party advertisers for their own marketing purposes without Your explicit, informed consent.
The Service uses cookies and similar technologies. Detailed information regarding the use of cookies, including legal bases and user choices, is provided in the Privacy Policy.
The Service may contain links to, or integrate with, third-party websites, services or platforms (including video conferencing, payment processing, cloud hosting and analytics providers). WLLNSS has no control over, and assumes no responsibility for, the content, privacy policies or practices of any third-party services.
You acknowledge and agree that WLLNSS shall not be responsible or liable for any damage or loss caused by or in connection with Your use of or reliance on any third-party content or services. We strongly recommend that You read the terms and privacy policies of any third-party services You access.
Where third-party services are accessed via social media integrations, Your use of those services is also subject to the applicable third-party terms and privacy policies.
WLLNSS may send You marketing or promotional communications, including newsletters, only where permitted under applicable law. Where required by law (including the Polish Telecommunications Law), such communications will be sent only on the basis of Your prior consent. You may withdraw your consent and unsubscribe from marketing communications at any time by:
Withdrawal of consent does not affect the lawfulness of prior processing.
We may suspend or terminate Your access to the Service with immediate effect and without prior notice where:
Where suspension is not urgent, We will endeavor to provide reasonable prior notice. Upon termination, Your license to use the Application ceases immediately. You must uninstall the Application from Your Devices. Provisions that by their nature survive termination shall continue to apply, including Parts J, M, N and O.
The Service is provided to You "AS IS" with all faults and defects and without warranty of any kind. To the maximum extent permitted under applicable law — and subject to mandatory consumer protection rights under Polish and EU law that cannot lawfully be excluded — WLLNSS, on its own behalf and on behalf of its Affiliates and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, including:
WLLNSS makes no warranty as to the accuracy, reliability, completeness or timeliness of any content, AI outputs, or information provided through the Service.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on applicable statutory rights of a consumer. In such jurisdictions, the above exclusions apply only to the greatest extent enforceable under applicable law. Mandatory statutory guarantees applicable to EU consumers are not excluded.
To the fullest extent permitted by applicable law, in no event shall WLLNSS, its Affiliates, directors, officers, employees, agents, licensors or service providers be liable for:
WLLNSS's total aggregate liability to You in connection with the Service shall not exceed the greater of: (a) the total fees actually paid by You to WLLNSS in the twelve (12) months preceding the event giving rise to liability; or (b) EUR 100.
Nothing in these Terms limits or excludes liability for: death or personal injury caused by WLLNSS's negligence; fraud or fraudulent misrepresentation; or any other liability that cannot lawfully be excluded or limited under Polish or EU law.
Some jurisdictions do not allow the limitation of liability for incidental or consequential damages. In such jurisdictions, WLLNSS's liability will be limited to the greatest extent permitted by law.
If You have any concern or dispute about the Service, You agree to first attempt to resolve the matter informally by contacting WLLNSS at s.atanasov@wllnss.health. We will use reasonable efforts to resolve Your complaint within 14 business days.
In accordance with EU Regulation No 524/2013 on Online Dispute Resolution, EU consumers may submit disputes for resolution through the European Commission's ODR Platform, accessible at: https://ec.europa.eu/consumers/odr. WLLNSS's email address for ODR purposes is: s.atanasov@wllnss.health.
You may also seek assistance from the Polish consumer protection authority: Urząd Ochrony Konkurencji i Konsumentów (UOKiK), pl. Powstańców Warszawy 1, 00-950 Warsaw — www.uokik.gov.pl.
These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law rules. Your use of the Application may also be subject to other local, national or international laws.
Subject to Your rights as an EU consumer under Regulation (EU) No 1215/2012 (Brussels I Recast) — including the right to bring proceedings in the courts of Your country of domicile — the courts of Warsaw, Poland shall have exclusive jurisdiction to resolve disputes arising from or in connection with these Terms.
If You are a consumer resident in the European Union, You benefit from any mandatory provisions of the law of Your country of residence that cannot be derogated from by agreement. Nothing in these Terms affects those rights.
We may amend these Terms from time to time for valid reasons, including legal, security, technical or business changes. Where changes materially affect users, we will provide at least 30 days' prior notice (via in-app notification or email). What constitutes a material change is determined at WLLNSS's reasonable discretion, having regard to the interests of users. For guidance, material changes include, without limitation: (i) changes to the scope of the licence granted to You; (ii) introduction of new fees or charges; (iii) material changes to data processing practices or the Privacy Policy; (iv) changes to the limitation of liability provisions; (v) changes to the governing law or jurisdiction; or (vi) changes that significantly affect Your rights as a consumer under applicable EU or Polish law.
By continuing to access or use the Service after revised Terms become effective, You agree to be bound by the updated Terms. If You do not agree, You must stop using the Service and, where applicable, cancel Your subscription.
WLLNSS shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including natural disasters, pandemics, war, acts of terrorism, government actions, action or inaction of telecommunications providers, internet infrastructure failures, or power failures. For the avoidance of doubt, this provision does not apply to the extent that any delay or failure results from WLLNSS's failure to maintain reasonable security measures in accordance with its obligations under applicable law, including Article 32 of the GDPR.
WLLNSS will notify affected Users as soon as reasonably practicable and will use reasonable efforts to resume performance.
By using the Service You confirm that You are not located in, or a national or resident of, any country or territory subject to comprehensive international sanctions, and that You are not listed on any applicable sanctions list (including, but not limited to, OFAC, EU and UN lists). You agree not to use the Service in violation of applicable export control laws or regulations.
WLLNSS may assign or transfer these Terms, or any of its rights or obligations hereunder, without Your prior consent, in connection with a merger, acquisition, corporate restructuring or sale of all or substantially all of its assets, provided the assignee assumes all WLLNSS's obligations under these Terms. You may not assign Your rights under these Terms without WLLNSS's prior written consent.
If any provision of these Terms is held invalid or unenforceable by a competent court, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. Failure by either party to exercise a right or enforce a provision shall not constitute a waiver of future enforcement.
These Terms are issued in English. If translated versions are made available, the English version shall prevail in the event of any discrepancy.
These Terms, together with the Privacy Policy and any applicable subscription-specific terms, constitute the entire agreement between You and WLLNSS with respect to the Service and supersede all prior agreements, representations and understandings.
